What this means in practice:

• Total Casino is the only licensed online casino in Poland. All other online casinos operate outside Polish licensing — mostly under a Curaçao licence, less often under a Malta Gaming Authority licence. Neither is a Polish licence.
• Register of Prohibited Domains. The Ministry of Finance keeps a public register of domains offering gambling contrary to the Act — more than 57,000 entries as of September 2026. Internet providers must block a listed domain within 48 hours. You can search the register yourself at hazard.mf.gov.pl.
• Payment blocking. Payment providers must stop serving a registered domain within 30 days of its listing, on pain of fines of up to PLN 250,000. In practice this is why card and BLIK payments to some international casinos fail.
• The rule for players. Polish law also addresses the player: taking part in a game of chance offered without a Polish licence is classed as a fiscal offence under article 107 §2 of the Fiscal Penal Code, with fines set in daily rates. It is a rule worth knowing before you choose where to play.

Total Casino (totalcasino.pl) is operated by Totalizator Sportowy, the state lottery company, under the supervision of the Ministry of Finance. The Ministry of Finance publishes the register of domains used to offer gambling contrary to the Gambling Act at hazard.mf.gov.pl. Search it for the casino’s domain before you deposit. A listed domain must be blocked by Polish internet providers within 48 hours and cut off by payment providers within 30 days, so a casino that works today may stop working, and a pending withdrawal can become hard to collect. A domain that is not on the register is not thereby licensed in Poland; only Total Casino is.

The tax position depends on where the casino is licensed, and it is not the flat rule most guides give.

• Total Casino: winnings are taxed at 10% and the tax is withheld at source. You receive the net amount and have nothing to declare.
• Casinos licensed in another EU or EEA state (for example Malta): article 21(1)(6a) of the Personal Income Tax Act exempts winnings from slot, card, dice, cylindrical and bingo games organised by an entity authorised under the gambling law of an EU or EEA state. The tax office has argued that the exemption does not cover online play from Polish territory, so the position is contested.
• Casinos licensed outside the EU/EEA (Curaçao, Anjouan): no exemption applies. Undeclared winnings can be assessed as income from undisclosed sources at 75%.
