There is no national licence. Each state decides whether to allow online casino games, and seven have done so. In all seven the minimum age is 21.

Maine passed an online casino law in January 2026 that gives the licences to its tribes, but the rules are still being written and no site is live; our Maine online casinos guide follows it. Nevada allows online poker only. In every other state, an online casino offering real-money slots or table games is not licensed there.
A licence covers one state. BetMGM in New Jersey, BetMGM in Pennsylvania and BetMGM in Michigan are three separate sites under three regulators, with separate accounts, game lists and offers. A casino that is legal in New Jersey cannot take your bet while you are standing in New York, and the sites check your location every time you play.
What matters is where you are, not where you live: you need to be 21 or older and physically inside the state when you play. The table above shows which brands hold a licence in Michigan, New Jersey and Pennsylvania; each state page lists that regulator’s sites in full.

The FBI gave the same advice in a public notice in December 2025: offshore gambling sites advertise to Americans, may offer none of the protections a licensed site must, and the way to tell them apart is the state gaming agency’s own website.
Offshore casinos hold licences from places such as Curaçao, not from a US state. Sweepstakes casinos sell coin packages instead of taking deposits. Neither is on any state regulator’s list, so the state cannot help you if a payout is refused.
Regulators have been acting on both. In August 2025 the attorneys general of 50 states and territories asked the Department of Justice to move against illegal offshore gaming operators. Michigan’s regulator publishes the operators it has sent cease-and-desist letters to, sweepstakes sites among them, and New Jersey enacted legislation against sweepstakes operators in 2025; our guide to sweepstakes casino bans by state follows each law.
